The German Constitutional Court has published its decision that the German Act implementing the Unified Patent Court (UPC) system is unconstitutional. In doing so the court has effectively ended, for the foreseeable future, an effort to create a single European court in which to hear all patent related matters. This decision is being celebrated by many in biopharma as it allows the continuation of the practice of litigating IP such as patents by jurisdiction and not universally.
